NOTICE OF SALE OF REAL ESTATE
WHEREAS, by Home Equity Line of Credit - Open End Deed of Trust dated
April 20, 2007, appearing of record in Deed Book T1796, page 1260, in
the Register’s Office of Madison County, Tennessee (“Trust Deed”),
Frank Polk and wife, Sherita Polk, conveyed to Investors Title
Company, Trustee, certain real estate hereinafter described, to secure
the payment of a certain indebtedness therein described; and
WHEREAS, default has been made in the payment of the indebtedness
secured by the Trust Deed, and FirstBank, the lawful holder of the
note evidencing the indebtedness, has declared the entire balance due
and payable; and
WHEREAS, Adam C. Crider was appointed Successor Trustee by instrument
appearing of record in Deed Book T1796, Page 1260 in the Register’s
Office of Madison County, Tennessee.
NOW, THEREFORE, notice is hereby given that on Friday, September 22,
2017, at 11:00 a.m., at the front door of the Courthouse in Jackson,
Madison County, Tennessee, I will sell to the last, highest and best
bidder for cash and free from equity of redemption, right of
redemption (statutory or otherwise), homestead, dower, elective or
distributive share, any right of appraisement or evaluation, and all
other exemptions of every kind, all of which were expressly waived in
the Trust Deed, the following real estate, lying and being in the
First Civil District of Madison County, Tennessee, and more
particularly described as follows:
BEGINNING at an iron pin in the south margin of Lexington Avenue and
in the East margin of McCree Street where the two streets intersect;
runs thence South 00 degrees 16 minutes West with the east margin of
McCree Street a distance of 260 feet toa stake atthe Southwest
corner of the parcel herein described; runs thence East a distance of
184 feet to a fence corner at the Southeast corner of the parcel
herein described; runs thence North with a fence line a distance of 67
feet to an iron pin at the Southeast corner of the A. U. Taylor
property; runs thence West with the south line of Taylor a distance of
110 feet to an iron spike at Taylors Southwest corner; runs thence
North with the west line of Taylor a distance of 218 feet to a point
in the Southern margin of Lexington Avenue; runs thence South 71
degrees 00 minutes West with the southern margin of Lexington Avenue a
distance of 77 feet to the point of beginning.
Being the same property conveyed to the grantors herein by deed
recorded in Deed book 600, page 23, in the Register’s Office of
Madison County, Tennessee.
Said property will be sold by me as Successor Trustee only and
subject to any unpaid taxes and assessments and all valid
restrictions, covenants or easements, if any, of record on said
property, and subject to any and all other liens having priority over
the Trust Deed. The Successor Trustee reserves the right to make oral
announcements at the time of the public sale which shall apply to the
terms of the sale. The Successor Trustee may postpone any sale
hereunder to another time or place by so announcing to all present at
the time and place of the sale scheduled herein, without the necessity
of any further notice whatsoever.
Other Interested Parties: None.
This is an attempt to collect a debt, and all information obtained
will be used for that purpose.
