NOTICE OF SUBSTITUTE TRUSTEE’S SALE OF REAL ESTATE

        STATE OF TENNESSEE, MADISON COUNTY, WHEREAS Leigh Ann Mathews
executed a Deed of Trust to B & H Finance, LLC, lender and Roger
Swaim, Trustee, which was dated November 21, 2016 and was recorded on
December 1, 2016 in Book T2035, page 1051, Madison County, Tennessee
Register of Deeds.
        WHEREAS, default having been made in the payment of the debt(s) and
obligation(s) thereby secured by said deed of trust, B & H Finance,
LLC appointed the undersigned, Byrd & Byrd, Attorneys at Law, PLLC, as
substitute trustee, by an instrument duly recorded in the Office of
the Register of Deeds of Madison County, Tennessee, with all the
rights, powers and privileges of the original trustee named in said
Deed of Trust; and
        NOW, THEREFORE, notice is hereby given that the entire indebtedness
has been declared due and payable as provided in the Deed of Trust by
the Holder, and that as agent for the undersigned, Byrd & Byrd,
Attorneys as Law, PLLC, by virtue of the power and authority vested in
it, will on Friday, February 2, 2018 at 10:00 a.m. at the usual and
customary location at the Madison County Courthouse, Jackson,
Tennessee, proceed to sell at public outcry to the highest and best
bidder for cash, the following described property situated in Madison
County, Tennessee, to wit:
BEGINNING at a stake 156 inches north of the north margin of Herron
Street and in the west margin of Gardner Street and runs thence west
150 feet to a stake; thence north 75 feet to the beginning, being
designated as Lot No. 11 and the north half of Lot No. 12 in Block No.
4 of Cedar Grove Subdivision. (Legal description taken from prior
deed.)
Being the same property conveyed to Leigh Ann Mathews by deed as
recorded in Book D735, page 1422 in the Register’s Office of Madison
County, Tennessee. Parcel ID Number: Map 100J, Group A, Parcel 7.00.
Address: 53 Gardner Street, Jackson, TN 38301. Current owner: Leigh
Ann Mathews.
Other interested parties: none.
        The sale of the property described above shall be subject to all
matters shown on any recorded plat; any and all liens against said
property for unpaid property taxes; any restrictive covenants,
easements or setback lines that may be applicable; any prior liens or
encumbrances as well as any priority created by a fixture filing; a
deed of trust; and any matter that an accurate survey of the premises
may disclose; and all right and equity of redemption, statutory or
otherwise, homestead, and dower are expressly waived in said Deed of
Trust, and the title is believed to be good, but the undersigned will
sell and convey only as Substitute Trustee.
        The right is reserved to adjourn the day of the sale to another day,
time, and place certain without further publication, upon announcement
at the time and place for the sale set forth above. This office is
attempting to collect a debt. Any information obtained will be used
for that purpose.
