SUBSTITUTE
TRUSTEES SALE OF
REAL ESTATE
WHEREAS, on
September 24, 2010, SHARTOM,
INC., by a Deed of Trust of record
in Book T1890, at Page 1131, in the
Registers Office of Madison
County, Tennessee; conveyed the
following described property in trust
to secure the payment of a
Promissory Note in the original
principal amount of Four Hundred
Ninety Nine Thousand Three
Hundred Ninety Six and 87/100
Dollars ($499,396.87), payable to
Farmers & Merchants Bank. This
Deed of Trust was corrected by a
Deed of Trust of Correction, dated
March 10, 2011, to correct the
Grantor from Shartom, Inc. to
Sharon B. Smith and Basil Joseph
Baudo Trust and Helen A. Baudo
Trust, collectively, of record in Book
T1901, at Page 1097, in the
Registers Office of Madison
County, Tennessee. A Loan and
Deed of Trust Modification
Agreement dated February 14,
2014, was filed in Book T1973, at
Page 406, in the Registers Office of
Madison County, Tennessee,
modifying the Deed of Trust and
Note of record in Book T1890, at
Page 1131, in the Registers Office
of Madison County, Tennessee, and
re-recorded in Book T1901, at Page
1097, in the Registers Office of
Madison County, Tennessee; and
WHEREAS, the undersigned was
appointed Substitute Trustee by
Farmers & Merchants Bank, which
appointment will be recorded in the
Registers Office of Madison
County, Tennessee prior to the deed
evidencing this sale; and
WHEREAS, default has been made
in the payment of said indebtedness
and other provisions of the Deed of
Trust have been violated, and
FARMERS & MERCHANTS
BANK, the lawful owner and holder
of the indebtedness, has declared the
entire amount due and payable as
provided by the Deed of Trust in
accordance with its terms, and
instructed the undersigned to
foreclose.
NOW, THEREFORE,
the public is hereby notified that the
undersigned Substitute Trustee will
sell the hereinafter described real
estate at public auction, to the
highest and best bidder, for cash in
hand paid, at the north door of the
Courthouse at Jackson, Madison
County, Tennessee, on Thursday,
November 8, 2018, at 12:00 oclock
noon, said property to be sold in bar
of the equity of redemption and
subject to the lien of all special
assessments against it. If the highest
bidder cannot pay the bid within a
reasonable time to be announced at
the sale, the next highest bidder will
be deemed the successful bidder.
Tract 1
Lying, and being situate in the City
of Jackson, 5th Civil District of
Madison County, Tennessee,
bounded and described as follows;
to-wit:
BEGINNING at a stake at the
intersection of the north margin of
the Wiley Parker Road and the east
or south right-of-way of Interstate
Highway No. 40, runs thence North
32 degrees East with the East or
South right-of-way of said Interstate
Highway No. 40 a distance of 448.8
feet to a concrete marker; thence
South 2 degrees West a distance of
387.5 feet to a stake in the north
margin of the Wiley Parker Road;
thence North 88 degrees 30 minutes
West with the north margin of the
Wiley Parker Road a distance of 252
feet to the point of beginning.

described in a Warranty Deed from
Helen A. Baudo to Sharon B. Smith,
dated June 2, 2003, and of record in
Book D640, page 914, Registers
Office of Madison County,

south margin of the Wiley Parker
Road, said pin being at Hunts
northwest corner and at the original
northeast corner of the tract of land
conveyed to Scottish Inns of
America, Inc. by Deed of Economy
Inns Corporation dated August 23,
1973, of record in Deed Book 277,
page 37, in the Registers Office of
Madison County, Tennessee; runs
thence South 3 degrees 52 minutes
West a distance of 125.25 feet to an
iron pin; thence South 88 degrees
59.5 minutes West a distance of
306.65 feet to an iron pin in the east
margin of the original right-of-way
of Interstate 40, also being in the
original east margin of an access
road now known as Wiley Parker
Road; thence with the east margin
of said Road North 26 degrees East
a distance of 137.94 feet to an iron
pin in the south margin of said Wiley
Parker Road; thence South 88
degrees 59.5 minutes east with the
south margin of said Road a distance
of 256.19 feet to the point of
beginning, and containing

described in a Quitclaim Deed from
Basil Joseph Baudo and wife, Helen

BAUDO TRUST, a one-half (1/2)
undivided interest and to the
HELEN A. BAUDO TRUST, a one-
half (1/2) undivided interest, dated
October 23, 2009, and of record in
Book D701, page 545, Registers
Office of Madison County,
Tennessee.

This sale is subject to all matters
shown on any applicable recorded
plat; any unpaid taxes; any
restrictive covenants, easements, or
setback lines that may be applicable;
any statutory rights of redemption

or federal; any prior liens or
encumbrances as well as any
priority created by a fixture filing;
and to any matter that an accurate
survey of the premises might

be good, but the undersigned will
sell as Substitute Trustee only and
will assign to the purchaser all
covenants of warranty contained in
said Deed of Trust.
The sale held pursuant to this Notice
may be rescinded at the Successor
Trustees option at any time. Said
sale may be adjourned to another
time or may be postponed to another
date by public announcement at the
appointed time of sale without
readvertisement.
