NOTICE OF SALE OF REAL ESTATE
WHEREAS, by Deed of Trust dated July 29, 2005, appearing of record in
Book T1691, page 1, in the Register’s Office of Madison County,
Tennessee (“Trust Deed”), Jerry C. Cunningham and Merry J. Cunningham,
conveyed to R. Bradley Sigler, Trustee, certain real estate
hereinafter described, to secure the payment of a certain indebtedness
therein described; and
WHEREAS, default has been made in the payment of the indebtedness
secured by the Trust Deed, and CEFCU, the lawful holder of the note
evidencing the indebtedness, has declared the entire balance due and
payable; and
WHEREAS, Adam C. Crider was appointed Successor Trustee by instrument
appearing of record in Book T2057, Page 1450 in the Register’s Office
of Madison County, Tennessee.
NOW, THEREFORE, notice is hereby given that on Friday, March 30,
2018, at 1:00 p.m., at the front door of the Courthouse in Jackson,
Madison County, Tennessee, I will sell to the last, highest and best
bidder for cash and free from homestead, equity of redemption,
statutory right of redemption, and relinquishes all other rights and
exemptions of every kind, including but not limited to statutory right
to an elective share in the property, all of which were expressly
waived in the Trust Deed, the following real estate, lying and being
in the First Civil District of Madison County, Tennessee, and more
particularly described as follows:
Lying and being in the First Civil District of Madison County,
Tennessee, to-wit:
Beginning at a point in the west line of Norvell Hickman Subdivision,
said point being south 11 degrees 15 minutes east 130 feet from a
point in the south property line of the Southgate Development, said
beginning point also being south 11 degrees 15 minutes east 110 feet
from the northwest corner of Lot No. 3 as it appears of record in
Section I, Norvell Hickman Subdivision in Plat Book 2, Page 116 in the
Register’s Office of Madison County, Tennessee; and runs thence east
149 feet to a point in the west margin of South Dixie Lane; thence in
a southeasterly direction with the west margin of South Dixie Lane 85
feet to a point; thence south 75 degrees 45 minutes west 147 feet to a
point in the west line of said Subdivision; thence north 11 degrees 15
minutes west 122 feet to the point of beginning. Being a very small
portion of Lot No. 3 and a major portion of Lot No. 4 of the Norvell
Hickman Subdivision, plus a triangular portion of land lying south of
Lot No. 4.
Being the same property conveyed to Jerry C. Cummingham and wife,
Merry J. Cunningham, by deed dated July 29, 2005, appearing of record
in Book D670, page 657, in the Register’s Office of Madison County,
Tennessee.

Said property will be sold by me as Successor Trustee only and
subject to any unpaid taxes and assessments and all valid
restrictions, covenants or easements, if any, of record on said
property, and subject to any and all other liens having priority over
the Trust Deed. The Successor Trustee reserves the right to make oral
announcements at the time of the public sale which shall apply to the
terms of the sale. The Successor Trustee may postpone any sale
hereunder to another time or place by so announcing to all present at
the time and place of the sale scheduled herein, without the necessity
of any further notice whatsoever.
