NOTICE OF SALE OF REAL ESTATE
WHEREAS, by Deed of Trust dated May 12, 2006, and of record at Trust Deed Book
T1758, Page 1412, Register’s Office of Madison County, Tennessee (“Trust Deed”), JAMES
RADFORD ELLINGTON conveyed to William H. Shackelford, Jr., Trustee, the real estate
hereinafter described, to secure the payment of certain indebtedness therein described; and,
WHEREAS, default has been made in the payment of the indebtedness secured by the Trust
Deed, and Ray Ellington and wife Hilda A. Ellington, the lawful holders of the note evidencing the
indebtedness, have declared the entire balance due and payable; and
WHEREAS, MATTHEW R. WEST was appointed Successor Trustee by instrument
appearing of record in Trust Deed Book T2218, Page 1798, Register's Office of Madison County,
Tennessee.
NOW, THEREFORE, notice is hereby given that on Thursday, April 27, 2023, at 12:00
o'clock noon, at the north door of the county courthouse in Jackson, Madison, Tennessee, located at
100 E. Main Street, I will sell to the last, highest and best bidder for cash and in bar of equity of
redemption, statutory right of redemption, homestead, curtsey and dower, including all elective share
and all other exemptions which are expressly waived and relinquished in said Trust Deed the
following real estate, lying and being in Madison County, Tennessee, and more particularly described
as follows:

Lying and being in the 10 th Civil District Madison County, Tennessee, to-wit:
A tract or parcel of land, lying and being situated in the 10 th Civil District of
Madison County, Tennessee, being the same property conveyed to James Radford
Ellington, by deed recorded in Deed Book D681, Page 470, in the Register’s
Office of said county (R.O.M.C.) and being more particularly described as
follows:
Commencing on a P-K Nail Set, in the centerline of Collins Road, being the
northeast corner of a tract conveyed to Joe Warren by deed recorded in Deed
Book 622, Page 371 (R.O.M.C.) In the northwest corner of the tract which the
herein described tract is a part, the northwest corner of a recently surveyed
122.958 acres tract, (Tract 1), which is part of the tract which the herein described
tract is a part:
RUNS THENCE S 54 degrees 00 minutes 24 seconds E, a distance of 238.07 feet,
along and with the centerline of said Collins Road, being the north boundary of
said Tract 1, to a P-K Nail Set, in the centerline of said Collins Road, being the
TRUE POINT OF BEGINNING, the northeast corner of said Tract 1 and the
northwest corner of the herein described tract, Tract 2;
RUNS THENCE along and with the centerline of said Collins Road, being the
north boundary of the herein described tract as follows:
S 51 degrees 28 minutes 37 seconds, a distance of 524.72 feet, S 54 degrees 51
minutes 22 seconds E, a distance of 491.06 feet, to a point in the centerline of said
Collins Road, being the northwest corner of the remainder of the tract of which
the herein described tract is a part and the most northern northeast corner of the
herein described tract;
RUNS THENCE S 03 degrees 18 minutes 24 seconds W, passing an Iron Rod
Set, at a distance of 28.66 feet, continuing a distance of 486.47 feet, for a total
distance of 515.13 feet, along and with a severance line, being the east boundary
of the herein described tract to an Iron Rod Set, being the southwest corner of the
remainder of tract of which the herein described tracts is a part and an interior
corner of the herein described tract;
RUNS THENCE S 75 degrees 39 minutes 46 seconds E, a distance of 1,188.21
feet, along and with a severance line, being the north boundary of the herein
described tract, to an Iron Rod Set, in the west boundary of a tract conveyed to
Ray Ellington and wife Hilda Ellington by deed recorded in Deed Book 534, Page
854 (R.O.M.C.), being the southeast corner of the remainder of the tract which the
herein described tract is a part and the most eastern northeast corner of the herein
described tract:
RUNS THENCE S 12 degrees 14 minutes 04 seconds W, a distance of 3,412.36
feet, along and with the west boundary of said Ellington tract, being the east
boundary of the herein described tract, to a Steel Fence Post Found, at a fence
corner, being the southwest corner of said Ellington tract, the northwest corner of
a tract conveyed George I Marshall and wife Selma S. Marshall by deed recorded
in Deed Book 53 Page 207 (R.O.M.C.) And an interior corner of the herein
described tract;
RUNS THENCE along and generally with a fence, being the west boundary of
said Marshall tract and the east boundary of the herein described tract as follows:
S 03 degrees 02 minutes 34 seconds E, a distance of 283.39 feet to a 10 inch Red
Oak, S 03 degrees 44 minutes 24 seconds E, a distance of 428.97 feet to a 18 inch
Red Oak, S 10 degrees 52 minutes 07 seconds E, a distance of 119.00 feet to a 24
inch Red Oak, S 15 degrees 04 minutes 01 seconds E, a distance of 197.12 feet to
a 18 inch Poplar, being an exterior corner of said Marshall tract, a point in the
north boundary of a tract conveyed to Mark Little by deed recorded in Deed Book
483, Page 864 (R.O.M.C.) And the southeast corner of the herein described tract
as follows:
RUNS THENCE along and generally with a fence, being the north boundary of
said Little tract and the south boundary of the herein described tract as follows:
N 83 degrees 49 minutes 58 seconds W, a distance of 362.52 feet, to a 6 inch
Hickory, N 86 degrees 49 minutes 31 seconds W, a distance of 2,244.17 feet to a
6 inch Black Gum, being a point in the north boundary of said Little tract, the
southeast corner of the aforementioned Tract 1 and the southwest corner of the
herein described corner of the herein described tract;
RUNS THENCE along and with a severance line, being the east boundary of said
Tract 1 and the west boundary of the herein described tract as follows: N 17
degrees 48 minutes 31 seconds E distance of 3,810.26 feet, to an Iron Rod Set, N
03 degrees 08 minutes, 29 seconds E, passing an Iron Rod Set, at a distance of
1,953.40 feet, continuing a distance of 29.76 feet, for a total distance of 29.76
feet, for a total distance of 1,983.16 feet, to the POINT OF BEGINNING,
containing 233.070 acres of land, more or less, and is subject to any legal right-of-
way of the aforementioned Collins Road.
Being a portion of the same property conveyed to Ray Ellington and his wife
Hilda Ellington by Warranty Deed of record in Book 508, at Page 96, in the
Register’s Office of Madison County, Tennessee.

Being the same property conveyed to James Radford Ellington, by deed dated
May 12, 2006, appearing of record in Deed Book D681, page 470, in the
Register's Office of Madison County, Tennessee.
The street address of the property is 1250 Collins Road in Medon, Madison County,
Tennessee. The street address is believed to be accurate, but should not be construed as part of the
legal description.
Said property will be sold by me as Successor Trustee only and subject to any unpaid taxes
and assessments and all valid restrictions, covenants or easements, if any, of record on said property,
and subject to any and all other liens having priority over the Trust Deed. The Successor Trustee
reserves the right to make oral announcements at the time of the public sale, which shall apply to the
terms of the sale. The Successor Trustee may postpone any sale hereunder to another time or place
by so announcing to all present at the time and place of the sale scheduled herein, without the
necessity of any further notice whatsoever.
